Supreme Court directed authorities to let Vice-Chancellor of Purbanchal University Maheshwor Man Shrestha and Dean of Faculty of Science and Technology Subha Narayan Pathak, to resume their offices.
Single bench of Justice Cholendra SJB Rana issued interim order to the authorities including Prime Minister Sushil Koirala, who is the ex-officio Chancellor of the University, to take up their official duties till a final verdict over the case is made.
The duo were suspended after the Commission for the Investigation of Abuse of Authority (CIAA) filed a corruption case against them in June last year . They were acquitted by the Special Court of corruption charges on March 16 .
However, the government had appointed Shirish Rijal as VC of Purbanchal University on March 25. Following his appointment, Rijal had appointed Dr Pawan Kumar Jha the Dean of the Faculty of Science and Technology at the University on March 29.
But, the apex court stayed both of the appointments today observing that both Shrestha and Pathak were relieved of suspension after being acquitted from the Special Court.
Shrestha and Pathak had filed a writ of certiorari at the apex court on Thursday, April 2, seeking a stay order against appointments of Rijal and Jha.
Meanwhile, the Court also directed defendants of the case including the Prime Minister's Office to furnish reasons within 15 days why the certiorari be not issued on the case as demanded by the plaintiffs.
