Today’s decision has cleared the decks to hold the FSU elections, slated for May 27.The university council, however, is planning to announce a new date claiming that it could not make preparations for the election as the case was still subjudice in the apex court.
A full bench of justices Ram Kumar Prasad Shah, Baidyanth Upadhayay and Tarka Raj Bhatta decided not to continue the interim order issued on April 22.
Responding to a writ petition filed by FSU presidents from 14 TU constituent colleges on April 18, a single bench of justice Gyanendra Karki after an initial hearing had ordered the university administration not to implement its decision.
The petitioners had claimed that since there is no age limit for students to be enrolled in TU colleges, setting an age bar in the election was illegal.
A Senate meeting led by Interim Election Government Chairman and ex-officio TU chancellor, Khil Raj Regmi, on April 6 amended several clauses of FSU regulations, put age limit for FSU candidates and adopted the mixed electrol system of elections.
