The Supreme Court (SC) on Tuesday issued a stay order against the procedure initiated for appointment of professor and assistant professors at Tribhuvan University. A single bench of Justice Girish Chandra Lal issued the order acting on a writ petition filed on Monday at the apex court, seeking nullification of the vacancies for the posts.
Advocates Sunil Ranjan Singh and Dipendra Jha had filed the petition saying that the advertisement of Tribhuvan University calls for application under open competition, without specifying seats under reservation quotas, which is against the Interim Constitution and the Civil Service Act, 2049.
Citing article 13 (3) of the Interim Constitution which mentions that the state will not make any discrimination against citizens based on class, gender, religion, and languages, the petitioners have asked the SC to scrap the advertisement.
The petitioners have demanded re-advertisement for the posts along with reservation quota. The Tribhuvan University on Monday published a vacancy announcement under open competition for the posts of 49 professors and 57 assistant professors.
